Terms of Service

Welcome to Temway. These Terms of Service ("Terms") govern your use of the Temway visual email builder and related services (the "Service") operated by Temway ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old and able to form a legally binding contract to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts

  • You sign in using Google. You are responsible for keeping your account secure and for all activity under it.
  • You must provide accurate information and keep it current.
  • You may not transfer your account without our permission.

3. Plans, Subscriptions, and Billing

  • Plans. We offer Free, Starter, Pro, and Max plans. Each plan has limits on workspaces, team members, emails, layouts, exports, storage, version history, and other features, as published on our pricing page.
  • How limits apply. Email and layout limits are lifetime totals that count all items you create (soft-deleted items do not count). Export limits reset each billing month. Test-send limits apply per user on a rolling 24-hour basis.
  • Payment. Paid plans are billed in advance through our payment provider, LemonSqueezy. Subscriptions renew automatically at the end of each billing cycle until you cancel.
  • Upgrades and downgrades. When you change plans, new limits and pricing take effect for the next cycle. On downgrade, certain limits may be held at your current usage until usage falls below the new plan's limit.
  • Free tier badge. Emails created on the Free plan include a "Designed with Temway" badge. Upgrading to any paid plan removes the badge.
  • Fees. Unless required by law, fees are non-refundable. We may change pricing with reasonable advance notice; existing subscriptions keep their current rate until renewal.

4. Your Content

  • Ownership. You retain ownership of the emails, layouts, images, and other content you create or upload ("Content").
  • License to us. You grant us a worldwide, non-exclusive license to host, store, process, and display your Content solely to operate the Service for you.
  • Responsibility. You are responsible for your Content and for ensuring you have the rights to upload it and that it complies with these Terms.

5. Acceptable Use

You agree not to:

  • Use the Service to send spam, unsolicited, or deceptive email;
  • Upload Content that infringes the rights of others or is unlawful, harmful, or malicious;
  • Attempt to access systems or data you are not authorized to access;
  • Interfere with or overload the Service, or bypass rate limits or security measures;
  • Resell or sublicense access to the Service without our permission; or
  • Use the Service in violation of applicable laws or third-party rights.

6. API Access

The Service offers a Public API governed by published rate limits. You must keep API keys secure and are responsible for their use. We may suspend API access that harms or risks the Service.

7. Temway Materials

The Service's software, design, branding, and documentation are owned by Temway and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or proprietary technology.

8. Suspension and Termination

  • You may stop using the Service and cancel your subscription at any time.
  • We may suspend or terminate access if you violate these Terms, fail to pay applicable fees, or create risk or legal exposure for us.
  • Upon termination, your right to use the Service ends. You should export any Content you want to keep before termination, as it may be deleted after a reasonable period.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that email rendering will be identical across every client.

10. Limitation of Liability

To the maximum extent permitted by law, Temway and its suppliers will not be liable for any indirect, incidental, special, consequential, or lost-profits damages, or for any damages relating to loss of data or email deliverability, arising out of or related to the Service.

11. Indemnity

You agree to indemnify and hold Temway harmless from claims, damages, and expenses arising from your Content or your violation of these Terms.

12. Changes to These Terms

We may revise these Terms from time to time. We will post the updated Terms and update the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by applicable law, without regard to conflict-of-laws principles.
